This Privacy Policy describes the types of information, including personal information, that Goose may collect from you or users of your Goose account (collectively, “you” or “your”) or that you may provide when you visit www.goose.pet, any predecessor or successor websites established by Goose that reference this Privacy Policy, and any Goose applications (collectively, the “Site”) or access or use the Goose Booking (as defined below) service or payment service offered through the Site (collectively, the “Service”). It also describes our practices for collecting, using, maintaining, protecting, and disclosing that information. As used herein, a “Goose Booking” shall mean any (i) booking, (ii) waitlist booking, and (iii) any other reservation option available to you through Goose.
This Privacy Policy applies both to persons who register or establish an account with Goose (“Account”) and to casual browsers of the Site. This Privacy Policy applies to information we collect on the Site and in email, text, and other electronic messages between you and Goose. This Privacy Policy does not apply to information collected by Goose offline or by any third party, including through any application or content that may link to or be accessible from the Site.
This Privacy Policy is incorporated into and made a part of Goose’s Terms of Use.
By accessing or using the Site, you signify your consent to this Privacy Policy. If you do not agree to this Privacy Policy, your choice is not to access or use the Site.
We may modify or update this Privacy Policy at any time in our sole discretion. We indicate at the top of the page when this Privacy Policy was last modified or updated. Your continued access or use of the Site following any modification or update constitutes and signifies your full acceptance of the changes.
If we make material changes to how we treat your information, we will notify you through a notice on the Site homepage and/or an email. You are responsible for periodically visiting the Site and this Privacy Policy to check for any changes.
When you register for an Account on Goose, you provide information about yourself, including your name, email address, phone number, physical address, important dates, credit card information, and pet information including name, weight, breed, vaccination records, and relevant health information. If you register for an Account using a third party, such as Google or Facebook, you authorize us to collect and use any information that you agreed such third party could provide to us in your privacy settings with such third party. You can modify your privacy settings with such third party directly.
When you make a Goose Booking, we collect information about your transaction, including the name and location of the facility, kennel, or other venue (“Business”) with which you made the Goose Booking, the date and time of your Goose Booking, your credit card information, the amount you pay, and items you booked.
When you communicate with us through the Site or via email or text, we keep a record of your communications.
Goose uses automatic data collection technologies to collect information when you visit and use the Site. Information collected by Goose through these technologies includes your IP address, the city in which your IP address is located, the type and version of the browser you are using, the website from which you came, your language preference, and how you interact with the Site. We do not require you to provide us with information to gain access to the Site; however, you may not be able to use certain features, products, or services (including, without limitation, the Service) unless such information is provided. You hereby consent to our collection of your information as outlined herein. We use the information that we collect about you or that you provide to us, including any personal information, (i) to present the Site and its contents to you; (ii) to provide you with information, products, or services that you request from us; (iii) to provide you with notices about your Account; (iv) to carry out our obligations and enforce our rights arising from any contracts entered into between you and us, including for billing and collection; (v) to notify you about changes to the Site or the Service; (vi) to alert you to new developments, features, and enhancements to the Site or Service and events of interest; (vii) to allow you to participate in the interactive features of the Site; (viii) to solicit feedback from you; (ix) to make updates to and to “debug” the Site or the Service; (x) to fulfill any purpose for which you provide it; and (xi) for any other purpose with your consent.
To the furthest extent permitted by law, by voluntarily providing us with your email address and phone number when you create an Account or at any other time, you are expressly opting in to receive email and text messages (SMS and MMS) related to your Goose Booking from Goose and Businesses, and push notifications from Goose relating to the Site and Services. You will have the opportunity to avoid receiving text messages related to a Goose Booking when creating the Goose Booking. When you provide your email address and phone number to Goose, you warrant that you are the current subscriber or authorized user of such accounts. You acknowledge that emails, text messages, and push notifications may be sent using automated technology, and that text messages between you and a Business relating to a Goose Booking you made are not promotional messages. You acknowledge and agree, without limitation, that all agreements, notices, disclosures, and other communications that we provide you electronically satisfy any legal requirement that such communications be in writing. You further acknowledge and agree that messaging and data rates may apply and that you are solely responsible for paying such rates. Please contact your mobile phone carrier for details. To revoke your consent to receiving communications from Goose and/or Businesses, you agree to follow the opt-out procedures provided below.
If you opt-in to using location services for any Goose applications, we may collect and store information about your current location to enhance and customize your experience using such Goose applications (e.g., by showing you nearby Businesses).
We may use and disclose aggregated information about our users, and information that does not identify any individual, without restriction. We may disclose information that we collect or you provide as described in this Privacy Policy (i) to any affiliates; (ii) for internal marketing and demographic studies; (iii) to our third-party service providers and partners (Businesses, payment processors, third-party delivery partners, analytics companies, third parties who deliver marketing messages and advertisements on our behalf, and strategic partners); (iv) to a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution or other sale or transfer of some or all of Goose’s assets, whether as a going concern or as part of bankruptcy, liquidation or similar proceeding, in which information held by Goose about the Site is among the assets transferred; (v) to our investors; (vi) to fulfill any purpose for which you provide it; and (vii) to any other third parties with your consent.
We may also disclose your information (i) to enforce legal rights and comply with any court order, law, or legal process, including to respond to any government or regulatory request; (ii) to enforce or apply our Terms of Use, Privacy Policy, and other agreements, including for billing and collection purposes; and (iii) if we believe disclosure is necessary or appropriate to protect the rights, property or safety of Goose, our Businesses, other Goose Account holders, or others. This includes exchanging information with third parties for fraud protection and credit risk reduction.
No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.
Currently, Goose maintains and stores your information on servers located within the United States. Therefore, your information may be transferred to, used, processed, or held by Goose in the United States for the purposes set out in this Privacy Policy. If you are accessing the Site from outside the United States, please be advised that United States law may not offer the same privacy protections as the law of your jurisdiction. By using the Site, you understand and consent to the transfer to, use, processing, and holding of your information on our servers in the United States and by those third parties with whom we share it as described in this Privacy Policy.
We respect the intellectual property rights of others. It is Our policy to respond to any claim that Content posted on the Service infringes a copyright or other intellectual property infringement of any person.
The safety and security of your information also depend on you. To protect your Goose Account, keep your account and password confidential. Do not share your Account or password with anyone or reuse your Goose Account password on third-party websites or applications. You are responsible for the activity that happens on or through your Goose Account. If you learn of any unauthorized use of your password or Goose Account, please email our Privacy Officer at privacy@goose.pet.
Unfortunately, we cannot ensure or warrant the security of any information you transmit to Goose. Any transmission of information is at your own risk. Once we receive your information, Goose uses commercially reasonable efforts to ensure the security of such information on our systems; however, we cannot guarantee that such information will not be accessed, disclosed, altered, or destroyed by breach of any of our physical, managerial, technical or other safeguards.
If Goose learns of a security systems breach, we will use commercially reasonable efforts to notify you electronically so that you can take appropriate protective steps.
We will retain your information for as long as your Account is active or as needed to provide you with the Services. We may retain aggregated information about our users, and information that does not identify any individual, without restriction.
You may review and change your information by logging into the Site and visiting your Account. You may also email our Privacy Officer at privacy@goose.pet to request access to, correct, or delete any information that you have provided to us. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.
You may delete your Account by emailing our Privacy Officer at privacy@goose.pet. Even if you delete your Account, we may retain your information in our electronic data and other files and use your information as necessary to maintain the security, integrity, and effective operation of the Site, to comply with our technical and legal obligations, to resolve disputes and enforce our agreements and policies, and to take other actions required or permitted by law. Deletion of your Account will not remove your interactions with other Site users from the Site. If you have interacted with other users of the Site, including but not limited to transferring a booking, such interactions may remain viewable in cached and archived pages or might have been copied or stored by other users of the Site. In addition, if certain information has already been provided to third parties as described in this Privacy Policy, retention of that information will be subject to those third parties’ policies.
If you would like to opt-out of having your information shared with parties outside of Goose, its affiliates, and its third-party service providers and partners, except to the extent required by law, court order, or as requested by other government or law enforcement authority, please email our Privacy Officer at privacy@goose.pet.
If you’d like to have your email removed from our promotional mailing list or a Business’s promotional mailing list, please email our Privacy Officer at privacy@goose.pet. You may also opt-out of promotional email messages from Goose or a Business by following the instructions contained within the emails sent to you by Goose or a Business, respectively.
You may opt-out of receiving text messages related to a given Goose Booking at any time by replying to any text message received with “END” or emailing our Privacy Officer at privacy@goose.pet. You will also have the opportunity to avoid receiving text messages related to a given Goose Booking when creating the Goose Booking. You understand and agree that you will have to repeat the opt-out process for any Goose Booking for which you have agreed to receive text messages, but for which you no longer wish to receive them. You may opt-out of receiving text messages for all of your Goose Bookings by emailing our Privacy Officer at privacy@goose.pet. You acknowledge and agree that you may continue to receive text messages for a short time while an opt-out request is processed.
You can use the settings on your mobile device to enable or turn off mobile push notifications from Goose and location services for any Goose applications.
Most browsers are automatically set to accept cookies whenever you visit a website. You can disable cookies or set your browser to alert you when cookies are being sent; however, some areas of the Site will not function properly if you do so. If you choose to share your information with any third-party website through buttons provided on the Site (e.g., you may share your booking information on Facebook and Twitter), you will post such information to such third-party websites outside of the Site. Because we cannot control the activities of third parties, including without limitation, Businesses, third-party payment processors, and social networks, we are not responsible for any use of your information by such third parties, and we cannot guarantee that they will adhere to this Privacy Policy. If you visit or share your information with a third-party website that is linked to the Site, you should consult that website’s privacy policy before providing any personal or other information.
You may choose to disclose information about yourself through communications with third parties through the Site; for example, if you choose to transfer a booking through the Site. Such information is public information, and there is no expectation of privacy or confidentiality. Goose complies with the EU-US Privacy Shield Framework and the Swiss-US Privacy Shield Framework as set forth by the US Department of Commerce regarding the collection, use, and retention of personal information transferred from the European Union and Switzerland to the United States, respectively. Goose has certified to the Department of Commerce that it adheres to the Privacy Shield Principles. If there is any conflict between the terms in this Privacy Policy and the Privacy Shield Principles, the Privacy Shield Principles shall govern. In compliance with the Privacy Shield Principles, Goose commits to resolve complaints about our collection or use of your personal information. European Union or Swiss individuals with inquiries or complaints regarding our Privacy Shield policy should first contact Goose at privacy@goose.pet.
Goose has further committed to refer unresolved Privacy Shield complaints to JAMS, an alternative dispute resolution provider located in the United States. If you do not receive timely acknowledgment of your complaint from us, or if we have not resolved your complaint, you may contact or visit JAMS at https://www.jamsadr.com/eu-us-privacy-shield for more information or to file a complaint. The services of JAMS are provided at no cost to you.
If your complaint is not resolved by Goose or JAMS, you may, under certain conditions, invoke binding arbitration for complaints regarding Privacy Shield compliance. In the context of an onward transfer, a Privacy Shield organization has responsibility for the processing of personal information it receives under the Privacy Shield and subsequently transfers to a third party acting as an agent on its behalf. The Privacy Shield organization shall remain liable under the Privacy Shield Principles if its agent processes such personal information in a manner inconsistent with the Privacy Shield Principles unless the organization proves that it is not responsible for the event giving rise to the damage.
